The plaintiff, a sociologist specializing in race and culture, filed a lawsuit in the New York Supreme Court, alleging that Wiley, who was a sophomore and star running back for the Columbia Lions in the fall of 1994, attacked her. The lawsuit claims that Wiley forcibly assaulted her in her freshman dorm room, disregarding her verbal objections and causing her to lose her virginity. This traumatic incident reportedly led the victim to attempt suicide.
The lawsuit asserts that Wiley’s actions were intentionally designed to inflict severe emotional distress on the plaintiff or were undertaken with reckless disregard for the substantial probability of causing such distress. Residential Dean Kathleen McDermott, who passed away in 2011, is reportedly accused of dismissing the victim’s harrowing encounter by suggesting that the victim, who was born in the African island county of Cabo Verde, misinterpreted the incident.
According to the lawsuit, McDermott allegedly conveyed to the plaintiff that, in her opinion, the defendant had not truly raped the plaintiff. McDermott purportedly argued that the plaintiff, being from Cabo Verde, had misunderstood the defendant’s actions because “people from different cultures interpret things differently.” Instead of facing expulsion, Marcellus Wiley was subjected to academic probation and instructed to finish the Spring 1995 semester remotely from his home in Los Angeles. Despite this disciplinary measure, he was eventually allowed to return to Columbia University to continue his academic and sports pursuits. Wiley went on to become the captain of the Lions, leading the team to one of its most successful seasons in decades.
Following the minimal punishment, the victim and a friend who had encouraged her to report the assault allegedly experienced a barrage of harassing phone calls in the months that followed.
