McCarthy attended Columbia College and Cardinal Hayes High School in the Bronx neighborhood of New York City. He joined the Federal Witness Protection Program as a Deputy United States Marshal after earning his degree from Columbia. He attended New York Law School and studied law while employed with the US Marshals Office. Later, he started working as a paralegal for the US Attorney’s Office for the Southern District of New York.
He was employed by Rudy Giuliani, the district’s US Attorney at the time, as a prosecutor at the Southern District in 1986. McCarthy led the prosecution of Sheikh Omar Abdel-Rahman and eleven other individuals in 1995 for their roles in the planning and execution of the 1993 World Trade Center bombing as well as their preparations for a number of further assaults on New York City landmarks. For five years, McCarthy led the Southern District’s satellite office in White Plains, New York, where he conducted investigations into the 1998 bombings of the US embassies in Kenya and Tanzania.
McCarthy rose to prominence as an essential piece of a prosecutorial command team entrusted with crafting search warrants and “connecting the dots” in the investigations that followed the September 11th attacks in 2001. In 2003, he departed the prosecutor’s office. McCarthy is the director of the FDD’s Center for Law and Counterterrorism in addition to being a senior fellow at the Foundation for Defense of Democracies. He has represented Rudy Giuliani as an attorney and writes opinion pieces for Commentary and National Review. Additionally, he has consistently contributed to Fox News and has held adjunct professorships at Fordham University School of Law and New York Law School.
